1. Introduction and Acceptance

Welcome to CyberAware360. These Terms of Service ("Terms") govern your access to and use of the CyberAware360 platform, a cybersecurity awareness Software as a Service (SaaS).

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these conditions, please do not use our services.

2. Description of Service

CyberAware360 provides a comprehensive platform allowing businesses to conduct phishing simulations, deliver interactive cybersecurity training, and generate compliance reports. The service is intended exclusively for professional (B2B) use.

3. Acceptable Use and Obligations

You agree to use CyberAware360 in a legal, ethical manner consistent with its intended purpose. You warrant that:

  • You will only use our phishing simulation tools on employees, collaborators, or systems for which you have explicit and written authorization.
  • You will not use our services to conduct actual cyberattacks, distribute malware, or compromise third-party systems.
  • You comply with applicable labor laws regarding employee monitoring and evaluation.

4. Personal Data Protection (Compliance with Law 2024/017)

As a platform developed and operated in Cameroon, CyberAware360 strictly complies with Law No. 2024/017 of December 23, 2024, relating to the protection of personal data in Cameroon.

Within the scope of using the service, you act as the Data Controller and CyberAware360 acts as the Data Processor. We only collect, process, and host your employees' data (names, emails, phone numbers, simulation results) based on your documented instructions and for the exclusive purpose of providing the service.

We implement appropriate technical and organizational measures to ensure the security and confidentiality of this data, in accordance with regulatory requirements.

5. Cybersecurity and Cybercrime

The use of the platform must strictly comply with Law No. 2010/012 of December 21, 2010, relating to cybersecurity and cybercrime in Cameroon. Any misuse of our simulation tools (e.g., fraud, identity theft for malicious purposes) will result in immediate account suspension and potential legal action.

6. Billing and Payment

CyberAware360 subscriptions are billed annually and payable in advance. Unless canceled by you before the end of the current period, your subscription will automatically renew. Payments are non-refundable, except where otherwise required by law.

7. Intellectual Property

CyberAware360 and all its content (code, designs, phishing templates, training videos) are our exclusive property. We grant you a limited, non-exclusive, non-transferable license to use the platform during your subscription term.

8. Limitation of Liability

Services are provided "as is". While we strive to ensure maximum availability, we do not guarantee that the platform will be uninterrupted or error-free. CyberAware360 shall not be liable for indirect damages, data loss, or business interruption arising from the use of our services.

9. Governing Law and Jurisdiction

These Terms are governed by Cameroonian law. In the event of a dispute that cannot be resolved amicably, the competent courts of the Republic of Cameroon shall have exclusive jurisdiction.
